My argument for yes: if you don't know by now that the rule is to observe the vial for any injected product with your own eyeball then i guess you consent to anything anybody in a lab coat gives you

No. And it's not a tough call. A Darwin award isn't awarded when someone's 'Darwin award' action skill another person. It's self-inflicted.
