They're not citizens, they have no rights on American soil. The constitution does not apply to illegal aliens. I would go so far as to argue that any and all "crimes" committed against illegal aliens could not be prosecuted, no matter the citizenship of the accused.
Ninja edit: not calling for violence. Just stated for the sake of legal argument. Say an American citizen runs a red light and hits an illegal alien. The alien gets deported, that's it. They would not receive any legal support of any kind, no lawsuits over loss of property for the vehicle, no lawsuits over any injuries sustained in the accident, etc.
