What part of the 2nd part they would violate by making they rules in their own subs as long as it doesn't break the ToS?
They wouldn't violate ToS if they made their own rules that don't break ToS. If free speech isn't part of this site's ToS then it wouldn't violate it, but that would just mean the ToS is flawed.

What part of the 2nd part do they violate that makes you unable to post or comment on the site? It's their sub, so they do as they want, and you are free to post somewhere else or even create an alternative sub and make it better.
How is that taking away your free speech?
