Last year a lower German court ruled that Formenek has a "permanent inability to stand trial" because of his age. Another court has overturned that ruling.

Under an unjust current German law, anyone who worked at a "concentration camp" may be held responsible for anything that happened within the camp, even if they did not participate in it and even if they had no knowledge of it. This includes clerical personnel working in a camp office, medical personnel, repairmen, & guards patrolling the outer perimeter.
