I guess that depends on what you mean by fair. I'd be hard pressed to call killing a pirate unfair, unless they surrendered themselves for trial or something like that. I doubt there was a man to man fight where all the others were ordered to just stand back and watch. But from what I heard his death sounded fair enough for me.
