The real fuckup the founding fathers made was not specifically stating timelines for speedy trials and court reviews. None of them thought any legislature would try to limit rights but they really made a mistake in not saying such cases must be reviewed and tried to conclusion by courts in 7 days or less. What happens now is rights are infringed by default for years by legislatures until finally some court gets around to reviewing it and you might get your rights back after years.
