Most poppies grown in the US are bred to not produce opium. Once in a while, you find the right kind. They're usually someone's strain that has been an heirloom perennial for many years, so ask old ladies.

Oh my dad grew it specifically for the opium, he got the seeds from afghanistan

I am pretty sure it's not illegal - until you harvest the opium from them.

I am not sure, he was never arrested for it. Though that could just mean he wasn't caught
