is this even legal for them to put in a TOS? would this even protect them a bit in court?

Arbitration is standard legal practice for how businesses handle disputes due to low costs and questions over jurisdiction enforcement, rapidly expanding in scope since the start of the 90's. Here's more information (cyber.harvard.edu) regarding E-Commerce arbitration.

Make your own ToS. I have mine. Basically it says "all other ToS are null and void" and things like "by letting me browse your website, use your software, use your services, procure and consume your goods, and take my money, you agree to My ToS".
