If they enlisted with the Ukrainian army, their nationality does not matter and as a bonus; when they deserted in times of war, it's a crime punishable by death..

I have no idea and don't know how you can enlist into Ukrainian armed forces as a forign national, but possibly it's sufficient to hook up to some faction, being registered by that..
Showing up on a battlefield without enlisting, participating in combat, makes you an illegal combattant, with likely next to no legal protection what so ever..
I imagine they 'enlisted' with the volunteer Georgian Brigade they were a part of. Zelensky also dropped visa requirements for anyone coming to Ukraine to volunteer for service. I have no idea of the actual details however i'm gonna assume one doesn't want to be an 'illegal combatant or a foreigner fighting in Ukraine without having a way to show Ukraine forces that you are actually on their side'....
