Option 3: Use the deep state to move the deal forward, blame Elon anyways and pass signature legislation to kneecap anything he does for "security" or some other bullshit premise
If Musk can't show a preponderance of evidence of fraud, he'll have to go forward with the deal or forfeit $1 billion, cash. If he does forfeit, that's a ton of revenue that'd make Twitter stockholders happy. So no, the news isn't happy.
Yeah right. $1 billion is nothing in comparison to Elon destroying all remaining credibility (in the eyes of investors) that Twitter management has left. Shareholders are going to go ape shit.
$1 billion is a bucket of piss compared to getting bought out by Elon.
If Twatter admitted that it only samples 100 accounts in determining the percentage of bots, that's basically an admission of fraud itself. The only reason to use such a tiny sample is to bias the results. It's almost certainly an automated process, so there's no real reason not to sample more accounts anyway.
That said I expect if it hits the courts it will be with an ultra-far left shitlib kike judge who will pretend that deliberately kneecapping your own bot detection is standard procedure and that if the real number is much greater than 5% that's fine because shareholders and advertisers shouldn't expect to get the service they paid for.
