Agree with #12. #11 is hard to do, NDAs and an independent review board might better protect their IP.

Their IP isn't the concern, election fraud is the concern. Once they have the contracts the election officials aren't going to go through the expense of changing the software anyway. It doesn't have to be "free and open source". It just has to be open source.
