Rule 1. Senate will vote on constitutionality of what us blatantly unconstitutional to pretend that's illegal is now legal when Congress does it.

I think the vote on constitutionality is being supported by both sides, for the same reason. The Rs and Ds want Senators to go on record either supporting or rejecting the claim. That gives them the ammunition to attack those who they feel are in the wrong.
