Mitchell should have been charged with two counts of manslaughter, since he was engaged in a felony activity in which two people were killed. Normally if a gang is robbing a bank and one of them is shot to death, his accomplices are charged with his death under existing case law. Any felony activity that results in a death should garner charges for that death for any active accomplices at the scene.
