plaintiffs in the case say the colleges violated the statute by considering students’ family income.

If you're being claimed on their tax returns, then it seems appropriate that the school is considering your family income.

The part about schools drawing up lists of wealthy applicants seems to be not relevant. The school is allowed to recruit anyone it pleases.
