They say everyone deserves another chance. I don't think that is true of actual murders or the rapist that also was convicted of murder. There is a difference if you get fucked by the system and are locked up for "murder" for protecting yourself or others. Thinks like "indecent exposure" should be case-by-case. You could be taking a piss in the woods and if a cop/sheriff/etc sees you they can write you up for it and you have to register as a sex offender.
