I’m not sure how arbitration works, specifically, and certainly not in Canada, but hopefully there is an appeals process or some other recourse.

If it is like the arbitration process I'm familiar with, the arbiter's opinions don't mean much. You can still go to court, you can still sue. The only thing is that now the arbiter's opinion can be presented to the court as evidence.
