That is not true. Lincoln basically allowed them in via executive order and the ratification was illegal because the seceded states were never recognized as seceded so they were legally still part of the US throughout the war and they never ratified WV.

To the victor go the spoils. Lincoln essentially pre-empted the state of VA asembly with that creative move. They were unprecedented times and unprecedented actions were taken. If the south had won, WV would still be part of VA.
