Prosecute him. No qualified immunity because he did not identify himself as a police officer when in plainclothes and off duty, so he was acting on his own. The department sure as hell did not train or instruct him to do takedowns in mufti without identifying. That places his actions outside the normal parameters of his departmental duties. Therefore, qualified immunity should not apply.
