The separation of powers doctrine ensures that the executive branch cannot undermine the judiciary’s authority to adjudicate cases. By preemptively absolving Fauci of responsibility for alleged crimes, a pardon could preclude judicial review and disrupt the balance of power.

So here is what I think today. The preemptive pardon could be viewed as a criminal deprivation of rights under color of law. Here is how: - Fauci is not convicted of a crime - Fauci is pardoned - Without a conviction the pardon has not been issued allowing for due process - crime: deprivation of rights (due process rights) under color of law and deprivation of a jury trial

Doesn't matter that this would be better for Fauci and he would prefer it. What matters is that not granting due process is a violation of rights and could be charged.

This is some Qanon level trust the plan bullshit and I don't believe it, but a prosecutor could try that angle, but prosecutors are comped.

The reason that the media is speculating that Fauci, Cheney and Schiff need pardons clearly demonstrates that a liberal protecting two-tiered justice system exists. They media know they covered for a politicized DOJ who allowed their activities. The DOJ did not charge solely based on their political party. Saying they need preemptive pardons clearly states they did something wrong. We all saw this before when they said Joe Biden had classified documents and refused to charge him because he was a senile old man.

Cynically this would be preferred to The House spending millions of our dollars investigating him and then there being no real accountability anyways. So pardon him and save the money. Of course they'd probably have the investigations anyways and we'd still be out the money.
