I'm beyond ready to kick out my former SO, the mother of my three children. Anyone have any experience with this?

FWIW, we're not married, we never presented ourselves as married, and we have never comingled assets. We have three kids together.

I'm not certain how to go about this without loosing access to my children, and I want to ensure they're with me as she is damn near unfit mother at this point.

Evicting her/him/zer/zim/they will depend upon state laws if you live in the USA. Most states recognize cohabitation for 7 years as a "Common-Law Marriage", even if you never "presented yourself as married". Production of children is usually proof of consensual cohabitation. If that is the case in your situation, you possibly could go to local family court and request a legal separation with child custody.

Common-Law marriages recognized in Community Property States means that one half of all assets could be adjudged hers and custody of children would be shared. Proving an "unit mother" is difficult unless you have clear proof of outrageous, deranged, unlawful or other behavior which endangers the welfare of the children. Legal measures will require lots of time and money to pay (((lawyers))) unless you go to court Pro Se (on your own behalf). That's a problem if her/him/zer/zim/they has a (((lawyer))).

The only good thing about my state is that it doesn't recognize any form of common law marriage.

She has an indicated letter from CPS for abuse.

She will get a (((lawyer))) because she make very little income on her own, and a lot of her income I think she is not reporting.

FWIW , the relationship was good for over 8 years, and then in the past 1.5 to 2 years, its fallen apart. Its to the point where I think something medically happened (stroke, mental breakdown, etc) but I wasn't able to get her to go see a doctor or therapist.

I told her mother , and then her mother was able to make things happen while she ignores what I say.

File for full custody and everything first then her lawyer will have to work back from that. Like today lawyer up and file.

Lawyers won't do anything until she is out of the house; and I'm trying to do that without her taking the children, but 100% on talking to lawyers. They just won't talk until she's out

That isn't true. You file for full custody.. the house whatever you want first before she gets a lawyer your lawyer will help.

Thats my current plan, but im waiting to do it when she decides for me to go to her therapy again. Its via video chat, so I record the video (single party consent state, and I don't share with outsiders, so I should be gtg)

Update: Mother of my children took them and ran after my youngest got hurt (with bonus CPS investigation!), She has left the county, I've retained a female attorney, as suggested here.

Children have their own lawyer

working on that, I have a log (as much as thats worth) I have limited video, but that is when she treats me like she treats the kids.

and I do know she did get a cps indicated letter

Someone else said lawyer, unfortunately I'd have to agree. They'd know better what you need to secure to sway a judge to leave them with you. Also, they'd know whether or not it matters about 'declared' marriage in your particular state, lengthy cohabitation might be enough for this to be divorce-ish.

I've spoken to two lawyers, the state/lawyers can't/won't do anything until we're not living in the same place. 100% good advice thought.

File for full legal full physical custody.

Explain why. Use legal code. Use legal precendece.

Ask ChaptGPT.

Fill out the forms. File them.

Ask for help from the self help center or family law facilitator. Show up first thing in the morning.

Don't give her forewarning.

Whatever her vice is, provide it for her. Let her go hog wild before you hit her with the papers. Serve her last minute.
