Other way around. You're allowed to vandalize any flag, so long as you own it. Vandalize someone else's flag and that's unlawful. (Good luck getting the law enforced if it's an American flag though.)
He's also allowed to fly a Mexican flag if he wants. It's if he flies an American flag subordinate to a Mexican flag that he's violating the US Code.
