Take the public defender and ask him if he thinks he can get it dismissed. You can always fire the PD at anytime and hire someone.

BTW you can only get shit dropped by hiring a lawyer. To drop shit on your own would require you to talk 1:1 with the prosecutor before trial. They would love that. Discussing your case with a prosecutor would be absurdly moronic.

A plea deal typically gets argued, "I would argue that my client actually did...", "and this should be the consequence". Imagine saying that to a prosecutor. You'd be confessing at some level just to float a possible agreement. The PD doesn't have the time to pursue the plea deal or charge drops as hard. They may have sufficient skill in the court room, hopefully, but you have a higher probability of arguing against the charges as they are, or a token drop of the lesser charge to save both the prosecutor and PD time with a plea (no trial), instead of the larger charge being dropped through a hired lawyer.

Yes. In fact the better your case the more you should get an attorney. He will leverage what is in your favor effectively, maybe even before court happens. A prosecutor sees someone without an attorney and they see easy pickings. In general you don't want to testify in court at all. In order to defend yourself on your own in court you will have to tell your side of the story which would mean testifying. It takes very little effort for a prosecutor to trip up what you say even if it's bullshit logic. A lawyer knows how to not feed prosecutors so he will make sure what is said in your favor accounts for all the angles of attack a prosecutor may approach.

Maybe the fact that you have an attorney and things are poorly documented will scare off a prosecutor completely, or at least get them to drop nearly all charges. In general if there is a process error you need an attorney to challenge processing.

Go to court, subpoena the officer and request to go over the evidence collected against you so you may build your case. There is a chance the prosecutor hasn't even filed a motion yet in hopes you are just going to plea guilty and pay the fine. In which case you can demand they do so in 30 days or be sentenced to jail time. Once you have a case against you, file an affidavit, saying you were indeed not intoxicated, there is no proof of it, and it's your word against an officers opinion.
