That's not going away, affirmative action has become diversity and inclusion. If affirmative action goes away via courts, nothing will change because laws like the Civil Rights Act has been modified to ensure it doesn't ever really go away.

If it gets struck down, yes, big if, then any such laws become illegal. Accordingly, anyone supporting these become open to constitutional rights violations. Obviously a condition of the big-if, I don't agree with your assessment.
