Thats not at all true. The second Amendment is a broad statute of force. Enemies foreign and domestic. Thats means enemies, and it does not matter if its the bogeyman or your uncle. EVERYBODY who presents themselves as an ENEMY.

Whatever legality BS you might present beyond the plain fact presented above is void. The true 'legality' of it becomes apparent every time a tyrannical government is toppled by its citizens demanding a better system through civil war.

(We're nearly at the point of Popular militias forming, declaring a Cassus Belli and guess what. Its legal from that point. No civil war has ever failed with the popular support of >3.5% of its population)
