The jogger was chased, and had a gun pulled on him. When someone holds you at gunpoint, they're preventing you from escaping (you run, they'll shoot you). The fact that he was chased, held at gunpoint, and then threatened, makes the shooter the aggressor, and being an aggressor pretty much immediately LEGALLY nullifies any self-defense claims.
If the shooter happened upon the jogger, and said "Hey, whoa, are you stealing? I'm calling the cops" and the jogger ran up and grabbed his weapon, or began threatening the shooter, causing a gun to be drawn and fired, it would be a different story. (But some of that also depends on the state, honestly. If it's not a stand your ground state, he could be fucked anyway)
