It isn't about whether they successfully imprisoned him, but that they were trying to illegally. It's like getting attacked while you rob a bank, so you shoot the attacker. You can't claim self defense in you are in the process of committing a felony. This is why knowing the law is important before doing shit like this otherwise you'll get fucked.
