The defendants have a huge problem in that case. The judge basically dismissed their citizen's arrest claims as a matter of law. That's a problem because the defendants admitted to the facts which the state no longer has to prove. Without citizen's arrest they are engaged in false imprisonment which means the jogger engaged in self-defense when he attacked them. Unless they can get the judge to reverse his ruling, they are going away for a very long time. They are toast.

The defense already admitted they were doing citizen's arrest. Judge rejected citizen's arrest, so that makes it false imprisonment.
Yep they jumped the gun, should have just argued an intent to investigate, said he was acting irrationally by charging a person with a gun and hoped the jury agreed.
The jogger wasn't imprisoned and literally ran past the truck and around the front to attack the man on the ground. SELF DEFENSE FROM CRAZY MONKEY.
It isn't about whether they successfully imprisoned him, but that they were trying to illegally. It's like getting attacked while you rob a bank, so you shoot the attacker. You can't claim self defense in you are in the process of committing a felony.
This is why knowing the law is important before doing shit like this otherwise you'll get fucked.
