My state just brought back masks and my job wants me to wear one again. i said i couldn't because of a disability and they couldn't ask about it because of the americans with disabilities act. thing is, i can't back that up if push comes to shove. is there anyway this can backfire on me and how sever could it be?

Go the other way... If push comes to shove, malicious compliance. Get a proper 3m respirator (not disposable, the kind that you get cartridges with)... Then make sure you mumble so no one can hear you.

If they complain, point out cloth masks offer no protection, and if its serious enough to warrant a mask, you have the right to wear a mask that works, there is no way on earth they can mandate shit mask but ban respirator.

Especially if you say you can breathe fine in chunky boy, but not cloth,

There is probably a critical mass of people who would go on a shooting spree before wearing a respirator all day. Do you know how insane those things are to breathe in? A proper dual canister respirator is easier to breathe in that those blue masks.

Enjoy the sweat that builds up between the rubber seal and your upper lip. These things weren't meant to be worn all day. Also, exhale valves absolutely are prohibited on aircraft right now.

They want you to wear a mask, that says on the box that it's not effective against coronavirus, because caronavirus. This is fake, they know it's fake. You're not going to comply with their nonsense rule that has nothing to do with medical reality. If they fire you, you will sue.

Yep. If they try to bring back masks at my job, I'm going to call OSHA because if an employer requires PPE they have to supply it, which means those mask boxes that specifically state they don't prevent anything aren't good enough and my employer must provide the real PPE which is expensive as fuck.

The HIPAA thing is really that they're not allowed to share your medical information.

They can ask, and it's up to you if you answer questions. But if you answer and they then tell someone your answer, they're in violation of HIPAA. Asking isn't a violation.

As for backfiring and severity, that depends on the laws in your state.

No they cant ask. HR basically exists to know what questions not to ask. They can't say, "do you have aids?" They also can't say "so ya takin any aids meds" by obvious.

Our legal guy said asking isn't a violation, only someone sharing the information without your permission is. (The exception is when the information is needed to facilitate medical treatment or process payments)

Lol, according to statute he's correct. But it's going to take the best jew law firm to explain why it was necessary to ask if the purpose isn't discrimination. Of course you can ask to support reasonable accommodations, but if you ask during an interview and then don't hire, good luck with that. No megacorp asks. They put a paragraph in their employee handbook telling people who need such accomodations to come forward to their supervisor. No one ever wants to ask. Too much liability. Too much to defend. But maybe your legal guy needs some job security.

just wear one the next time you are talked to then about 10 minutes later "pass out" and hit your head . Make a big scene, fall were people can see you. maybe even practice the fall at home free days off!

If they still insist on you wearing the mask, keep passing out. Since it's a workplace injury it will be covered by worker's comp. Employers really don't like that as it can hike their insurance rates.

Yeah do a combination of what many others here are suggesting - your company needs to provide the actual ppe for it's employees - politely point out the disclaimer on the box that theses masks do not provide adequate protection , if the business wants you to wear an effective mask they need to then provide (a more expensive) filtered mask - when anyone talks to you continually speak soft/ mumble so they are constantly repeating 'say again', throughout the following days after already casually pointing out you 'feel short of breath wearing them for any length of time' - feign slight breathlessness/ dizziness - then one afternoon just fcking collapse in the cafeteria or wherever onto a table or bench top ( make a big mess -drop the coffee jar whatever, lol) but make sure to crack your head - like literally and purposely bang your face/ head - bloodied nose / black eye/ lump on the forehead etc ( get some decent 'injuries') - all the better - go doctor -headaches / slight concussion etc etc - couple of days off to recover. Come back to work rinse and repeat..... Play the long game.

Quit your job and become independent, grow your own animals (pigs and chickens can feed your family for a year and you can plant a field of corn and barley for $50 to feed them all year, your people need you to stop slaving for the jew bucks in the jew race paying all the jew taxes/extortions that come with it. Tell your boss that you know where he leaves and that if he starts to push this bullshit on you in such a way that it forces you out of a job, then you will be paying him a visit. Then do it and be ready to do it to the police immediately after.
