I live in a pretty decent neighborhood and don’t want any trouble with the neighbors, but the problem is the next door neighbors have a completely fenced off yard yet they leave the gate open at night and their dog is allowed to roam free. It usually sneaks and takes a shit in the yard which I have dealt with all year, however now it has gone too far and shit right on top of some garlic that is almost ready for harvest. I work 3rd shift so I can stalk the yard and catch the bastard in the act if I need to. What would you guys recommend?

Let me try this. If your neighbor had a retarded kid that shat in your yard instead of a dog, at what point would your solution be to kill the kid? If there is no point that you would cross that rubicon then you can't justify it for the dog either. People consider their dogs to be members of the family. If you were to kill my dog for whatever reason God himself couldn't save you from me.

I don't expect you to be scared of me, I am just pointing out you shouldn't think killing a dog is okay and you damn sure shouldn't suggest others do it. There are people, myself included, that value their dog well above your sorry excuse for a life. If you shoot someones dog, you may get shot in return.
