It's not illegal under the laws against threats. It was specifically tested, a KKK guy said "We should kill all the blacks" and that was consdiered protected speech. Brandenberg V Ohio IIRC.

It's illegal to do it to a protected class under the civil rights act. Which is exactly why this unconstitutional law was passed.
