Well even if there are consequences even severe ones for optiing out you still have the option of opting out don't you? I mean all choices have consequences some more severe that others. So isn't it still a choice at that point?

It's a choice to breach the contract. There is never a choice whether or not to sign it. You are assumed in, unlike any other contract.
